Terms of Service
Effective date: July 18, 2026
1. Acceptance
By accessing or using keroiq.com or any KeroIQ application (the "Service"), you agree to these Terms of Service. If you do not agree, do not use the Service. KeroIQ LLC ("KeroIQ," "we," "us") reserves the right to update these terms at any time. Continued use after a change constitutes acceptance.
2. The Service
KeroIQ provides business-management software for mobile coffee carts and small food operators, including tools for menu management, order ahead, inventory, reporting, and related features. Operator accounts are for businesses; end customers interact with the Service only to place orders with a specific operator.
3. Payments — Square and the shop operator
When you place an order through KeroIQ, your payment is processed by the individual shop operator using Square. The shop operator — not KeroIQ LLC — is the merchant of record for your purchase. KeroIQ does not hold, process, or have access to your payment card information. Refund requests, disputes, and questions about a specific order should be directed to the shop operator you ordered from.
4. Loyalty program (where offered)
Some shop operators using KeroIQ offer an optional loyalty program to their customers. Joining requires a phone number and a valid email address. Your email address is required solely to authenticate your account — we send a one-time verification code to confirm it's really you (two-factor security) before showing your rewards balance, order history, or saved favorites, and before letting you sign in on a new device. We do not use your loyalty email for marketing or promotional messages, and we do not share it with third parties. Points balances, redemption rates, and program rules are set by the individual shop operator and belong to that operator's loyalty program only — points do not transfer between shops. KeroIQ LLC does not sell or share loyalty program data for advertising purposes.
5. Acceptable use
You agree to use the Service only for lawful purposes and in accordance with these terms. You may not: (a) use the Service to violate any applicable law or regulation; (b) attempt to gain unauthorized access to any part of the Service; (c) interfere with or disrupt the integrity or performance of the Service; (d) submit false, misleading, or fraudulent information; or (e) use automated means to access the Service without our written permission.
6. No warranty
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
7. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, KEROIQ LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID TO KEROIQ IN THE TWELVE MONTHS PRECEDING THE CLAIM.
8. Operator responsibility
Operators who use KeroIQ to run their businesses are responsible for their own compliance with applicable laws, including food safety, business licensing, sales tax collection, and consumer protection requirements. KeroIQ provides tools to help operators run their business but does not act as a food service provider, employer, or agent of any operator.
9. Changes
We may update these terms from time to time. We will post the revised terms with an updated effective date. For material changes, we will take additional steps such as notifying registered operators by email. Your continued use of the Service after any change constitutes acceptance of the new terms.
10. Governing law
These terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes arising under these terms shall be resolved in the state or federal courts located in Contra Costa County, California, and you consent to personal jurisdiction there.
